THE PROP. 1 DITCH INCENTIVE If Houston voters pass Proposition 1 in November, the average homeowner will pay about $5 a month to the city’s new drainage and street-renewal fund, Mayor Parker announced today. Commercial properties and homes on curb-and-gutter streets would be assessed 3.2 cents per sq. ft. of hardscape (including building footprints, driveways, porches and parking lots) per year. But owners who live on streets with open ditches would only have to pay at a 2.6-cents-per-sq.-ft. rate. That’d save the average ditch-side homeowner a whopping $11.40 a year. HOUSTON’S NATURAL GAS PARKS Isn’t it about time this city got back to basics? A company called Southern Star Exploration will soon be setting up drilling rigs outside 3 city parks and a city service center in northeast Houston. Yesterday city council approved a 3-year oil and gas lease to let the company explore possible reserves under Herman Brown Park, Maxey Park, Brock Park, and a public works facility on McCarty Rd. What’s in it for the city? $200,000 for the lease, plus a promised 25 percent of any royalties. Mayor Parker says she doesn’t want drilling rigs set up on city property, but she’ll “look for more opportunities” for horizontal or slant drilling to get at what lies beneath. Y’ALL CAN DISCUSS THE WEST END WALMART ON YOUR OWN Missed all the fun at last week’s big celebration of Walmart’s impending arrival in the Inner Loop? Two ways you can still get in on the action: Mayor Parker’s office has posted videos of the presentations given by the mayor and chief development officer Andy Icken at the gathering. And a second public meeting is scheduled for tonight, at a venue guaranteed to keep things orderly — The High School for Law Enforcement and Criminal Justice. A few highlights from last night’s meet-and-jeer on the third floor of the George R. Brown Convention Center Downtown, where representatives of Walmart, Ainbinder, and the city gave presentations on the Walmart and related retail developments proposed for the area around Yale and Koehler streets in the West End:

  • Mayor Parker announced she had originally hoped to hold the meeting at the United Way building at 50 Waugh St. in Memorial Heights, but the nonprofit turned her down — probably because of concerns it might get “rowdy,” she joked. But the night’s meeting format seemed designed to keep public outbursts to a minimum: After the presentations, attendees were asked to break up into smaller groups and gather around tables in the back to get their questions answered, one by one, from city officials or developer representatives. Before attendees could be dispersed, though, a few people managed to work their way to a microphone and ask questions or make statements in front of the entire room.
  • A significant percentage of the crowd wore “I don’t want that Walmart” red shirts. It wasn’t clear what portion of the less-vibrantly-dressed people there supported the development, but during his presentation Walmart senior VP Jeff McAllister did announce that many of the company’s suppliers were in attendance.

WILL NEIGHBORHOOD PROTECTION BE RELEASED FROM POLICE CUSTODY? Mayor Parker wants the city’s Neighborhood Protection division — responsible for policing dangerous buildings, illegal dumping, and runaway weed farms — moved out of the Houston Police Department. She tells abc13’s Andy Cerota she wants the enforcement group set up with “its own identity”: “The Houston police officers handling code enforcement violations would no longer be permanently assigned there. They would, instead, be moved elsewhere. . . . ‘This is not about saving money. It’s not about reducing overtime for the police department. It is about making sure the civilian side of the neighborhood protection division is unleashed to be doing what it should be doing out in the neighborhoods,’ Parker said.” [abc13]

The mayor’s office is out with a “public comment draft” of proposed changes to Houston’s Historic Preservation Ordinance. The biggest (and most expected) change: There’ll be no more 90-day “compliance waivers” issued for historic-district properties. Under the previous ordinance, owners of contributing properties in historic districts whose plans for new construction, demolition, or renovation had been rejected by the city’s historic commission could proceed with those plans anyway after simply waiting 90 days. Under these changes, the Old Sixth Ward — labeled a “protected” historic district because the waivers weren’t allowed there — will now be the model for all others.

But the changes also include a completely revised process for neighborhoods to vote on historic-district status. Previously, for a neighborhood to file an historic-preservation application, it needed to submit a petition signed by owners representing more than 51 percent of its tracts. But the new system puts power into the hands of owners who are willing to express an opinion and takes it away from those who can’t be bothered or found. It allows an application to be filed if 67 percent of the property owners in a district who send in special cards distributed for that purpose indicate on those cards that they’re in favor of the designation.

MAYOR PARKER TO WALMART: START TALKING “This is not yet a done deal. The property has been assembled for a major retail venture. When that moves forward, there will be careful review for impact on traffic, mobility and city infrastructure. I encourage Wal-Mart, or any other retailer interested in the property, to open dialogue with the Greater Heights and Washington Avenue Super Neighborhoods 15 and 22 as well as other neighborhood groups and civic clubs in that area.” [Hair Balls; previously on Swamplot]

HOUSTON’S HISTORIC HOLD As expected, city council approved yesterday what Mayor Parker called a “pause in the action” that would prevent until the end of the year all historic-district demolitions and new construction not specifically approved by the city historical commission. Previously, the city’s sharp-gummed preservation ordinance allowed property owners whose plans for historic-district properties had been rejected by the commission simply to wait 90 days before proceeding with their projects anyway. Mayor Parker says she hopes a revised permanent ordinance can be crafted and voted on by September. An amendment also passed by council provides a special exemption for property owners who have already spent money on new construction. The approved temporary changes will also prevent new applications for historic districts from being filed. But the timing worked out for Glenbrook Valley, the Woodland Heights, and Houston Heights South districts anyway — all three neighborhoods got their applications in under the wire. [HTV]

A TEMPORARY HOLD ON THAT TEMPORARY HOLD City council yesterday postponed for a week a vote on some temporary changes to the city’s historic-preservation ordinance — but not before supporters added an amendment that would exempt neighborhoods already in the process of applying for historic-district status from a proposed 7-month ban on the creation of new districts. As Swamplot reported last week, the changes would temporarily prohibit historic-district homeowners whose demolition, renovation, or new construction projects are rejected by the city’s historic commission from simply waiting 90 days and proceeding with their plans anyway. Mayor Parker wants the ban on 90-day waivers to allow a “breathing period” — during which more permanent changes to the historic-preservation ordinance could be crafted. [HTV]

Some major changes to the implementation of Houston’s long-ridiculed historic preservation ordinance may be coming very soon, if a proposal supported by Mayor Annise Parker passes a city council vote that could occur as early as next Wednesday, Swamplot has learned. Under the current ordinance (for all designated historic districts except for the Old Sixth Ward, now a designated “protected” historic district), owners of historic-district properties whose plans for demolition, new construction, or remodeling have been rejected by the city’s Archaeological and Historical Commission have been able to proceed with their plans anyway — simply by waiting 90 days.

But in an email to Swamplot, a spokesperson indicates the Mayor wants the commission to “temporarily discontinue” the issuing of such 90-day waivers for the remainder of this calendar year — or until amendments to the preservation ordinance are hashed out and approved by city council (whichever comes first). Under some revisions to the ordinance likely to be considered in that 7-month period, 90-day waivers could be eliminated entirely.

Swamplot was alerted to the potential changes by a builder, who became alarmed that “anyone, property owner or builder, who does not already have a Certificate of Appropriateness for demolition or new construction as of next Wednesday will not be able to get one until next year.” The changes the Mayor is proposing aren’t quite that drastic, however. Parker communications director Janice Evans indicates that the Houston Archeological and Historic Commission will still issue “certificates of appropriateness” while any moratorium on 90-day waivers is in place; anyone whose request for a certificate has been rejected will be able to appeal the decision to the Planning Commission.

What permanent changes to the preservation ordinance are being considered? A committee led by council member Sue Lovell — including fellow council member Ed Gonzalez as well as representatives of the historical and planning commissions — has been charged with reviewing it. All changes, notes Evans, “will be considered by the HAHC, the planning commission and City Council, providing numerous opportunities for dialogue and public input.” In the meantime, the mayor “supports the temporary discontinuance because it will allow for a pause in activity while discussions regarding increased protections occur with various stakeholders,” Evans tells Swamplot.
