To the reader who wrote in to Swamplot noting that Japanese restaurant Oishii at 3764 Richmond near Greenway Plaza was closed and that a large For Lease sign had been posted in front: Do not worry. Your sushi happy hour is safe. The restaurant is resting temporarily so building surgeons can give a portion of the lowslung structure at the corner of Timmons that raised eyebrow look that’s been all the strip-mall rage since about 1992. The restaurant closed down December 19th, and is scheduled to reopen January 10th.

Yesterday Swamplot reported that planning director Marlene Gafrick had signaled to city council that 5 of the 7 historic districts being “reconsidered” had not met the threshold that would have triggered dissolving them (the return of surveys representing owners of 51 percent of the properties in a district). The survey processes in the 2 remaining districts, Norhill and First Montrose Commons, are a little behind the others: Neighborhood meetings required by the revised preservation ordinance have been scheduled, but owners there haven’t received their survey forms yet.

But even if those last 2 districts don’t make the 51 percent cut either, the process spelled out by the new ordinance won’t come to an immediate halt. Once the votes have been tallied for all 7 districts, Gafrick will be required to send a report to city council recommending one of 3 options for each of them. For Heights East, Heights West, Heights South, Boulevard Oaks, and Avondale West, the first option — dissolving the district entirely — is out. But Gafrick can still recommend adjusting the boundaries of a districteven if the returned surveys didn’t reach the 51 percent threshold. (Her third option: recommend city council do nothing — and keep the district as it is.)

Having perhaps worked its way through the 100,000 gallons of raw sewage dumped into Buffalo Bayou shortly before New Year’s, the Houston Ship Channel received an additional contribution late yesterday: 15,000 gallons of beef tallow, which leaked into the waterway from a storm drain. There is, of course, much more where that came from: a rupture in an onshore tallow tank owned by a California company called Jacob Sterns and Sons caused 250,000 gallons of animal fat to spill on the waterway’s northern banks. A three-quarter-mile stretch of the channel — from City Dock 16 to the Buffalo Bayou Railroad Bridge — has been closed.

A source tells Swamplot that “an even sweeter deal” has just been struck between Books-A-Million and the management of Houston Pavilions, and that the bookstore chain has decided that its Downtown Houston store will remain open. “It seems the story has forced the company’s hand,” says the source. Swamplot reported yesterday that Books-A-Million had decided to close its store in the mall at 1201 Main St., even though the company was paying only $3,000 a month for the 2-story, approximately 23,000-sq.-ft. space.

Update, 1/5: Unless, of course, city council decides to shrink a few of them anyway.

The results are in, and it looks like the great campaign to dissolve Houston’s historic districts has been a bit of a bust. Houston planning director Marlene Gafrick reports that the “survey period” for Heights East, Heights West, Heights South, Boulevard Oaks, and Avondale West historic districts has closed and that the planning department has determined that “none of the districts achieved the 51% threshold that requires the Planning Director to recommend repeal of the designation or, in the case of Heights South, recommend denying the designation.” Neighborhood meetings and subsequent “surveys” for 2 more districts — Norhill and First Montrose Commonshaven’t taken place yet (the meetings are scheduled for January 8th and 18th, respectively). That’s it for the 7 districts where petitions from owners triggered the “reconsideration” provisions of the preservation ordinance changes city council approved last fall. According to the new ordinance, if owners of 51 percent of the lots in any of the districts had returned notices sent to them by the city, the districts might have been dissolved — or, more likely, had their boundaries adjusted.

Opponents of the preservation-ordinance changes had focused their dissolution campaign on the Heights historic districts. But if the 51 percent threshold wasn’t attainable in those districts, it seems less likely their efforts will succeed in Norhill and First Montrose Commons. Meanwhile, the city’s planning commission and archeological and historic commission have both recommended that city council approve 2 additional pending historic districts, in Woodland Heights and Glenbrook Valley.

Nestlé Waters of North America, distributors of the Ozarka, Arrowhead, Calistoga, Ice Mountain, Poland Spring, Zephyrhills, Nestlé Pure Life and — yes — Deer Park brands of drinking water, has chosen to set up its next bottling operation at the corner of Bay Area Blvd. and Red Bluff Rd. But the nation’s largest bottled-water company isn’t simply seeking a Pasadena address for the convenience and caché that undoubtedly comes with the location — close to the port and just a few miles south of the city’s famed refineries and sewage-treatment plant. Nestle has also worked out an agreement with the city to use water from Pasadena’s Southeast Water Purification Plant, which is located just northeast of Ellington Field. By next year, the company plans to have 3 separate manufacturing lines in operation, each staffed by 50 employees, bottling water in a new 312,000-sq.-ft. space it’s leasing in Pasadena’s Republic Distribution Center.

WORK ON THE NEW LIGHT RAIL LINES Construction crews are back at work on the North and Southeast rail lines and federal funds have been flowing again to Metro, Chris Moran reports. Late last year, the transit agency was able to cancel the notorious $330 million contract with a Spanish railcar vendor that violated federal procurement rules — but it won’t get back the $27 million it already spent: “Last month, the Federal Transit Administration sent the first $50 million of the grant money for use on the North and Southeast lines. Last week, the FTA issued pre-clearance letters Metro needed before it could proceed with more than $12 million worth of projects for which it is relying on federal reimbursements. Ultimately, the FTA will pay about half the cost of the North and Southeast lines.” [Houston Chronicle; previously on Swamplot]

COMMENT OF THE DAY: HOW TOUGH WOULD IT BE TO TURN HOUSTON PAVILIONS INSIDE OUT? “This was mentioned before with the Pavilions…but worth mentioning again—who designed the layout? I agree with other posters—if you drive by you hardly notice the Pavilions exist. The stores face inward so things may be noticeable if [you’re] passing (i.e. walking) through it….but not if you’re driving by from the streets. This is Houston…we don’t exactly walk outside. A reader tells Swamplot a sticker on the front door of the 10-story mixed-use building at 3400 Montrose notes the building is unsafe and does not have a working fire-alarm system:

They have gated off the garage and also all the first level tenants have now moved out. Any word on what is going on? Is the building being closed up? Torn down?

Renovated?

The building’s highest-profile (and -altitude) tenant, Scott Gertner’s Skybar, moved out over the summer, after complaining that the building’s new owner, a company out of Waco called FH Properties, wasn’t responding to maintenance concerns.

Update, 1/4: Reverse! Books-A-Million is gonna stay put.

Southeastern U.S. chain Books-A-Million has decided to close its Downtown Houston store on January 15th. The decision has left management of Houston Pavilions feeling rather put-out: Managers at the downtown mall reportedly had lowered the bookstore’s rent on the 2-story, approximately 23,000-sq.-ft. space facing the light rail line at 1201 Main St. to just $3,000 a month — in hopes the concession would prevent it from shutting down. A source insists the store “wasn’t a huge flop,” but says that the Katy Mills Mall Books-A-Million typically brought in more than 5 times the sales of the Downtown store — even though the 2 locations are about the same size.

Another factor that may have played a role in Books-A-Million’s decision to close: A pending lawsuit filed against the company after the location’s former manager reportedly kicked a man and his wheelchair-riding, apparently mentally disabled son out of the store. “At some point [the son] soiled himself and the [manager] took this as a vagrance and kicked them out. Needless to say the boy’s family were outraged,” a source tells Swamplot. The manager is no longer with the company, though reportedly for “unrelated” reasons.
