Update, 1:40pm: A revised press release from the mayor’s office now indicates the settlement was for all 6 trees, not 4 as previously indicated. We’ve updated the story below.

A just-announced legal settlement signed late last week means that the owner of the Wendy’s franchise at 5003 Kirby Dr. will be paying a $300,000 fine to the city for the late-night chopping-down and mulching-up of oak trees in the public right-of-way in front of the restaurant late last month. Six trees lining Kirby and North Blvd. were removed in the nighttime incident (illustrated in the before-and-after photos above), which was first reported on Swamplot. Crews from Freddy’s Landscaping and More carried out the tree-removal work under contract; the settlement, however, is to be paid entirely by Mohammed A. Dhanani and HAZA Foods, the Wendy’s franchise owner. All construction work on the restaurant, which was closed and undergoing renovations when the trees were removed, had come to a stop after city officials became aware of the clandestine street-visibility-improvement operation.

That’s more than 4 times the number of trees turned to mulch in the overnight removal of street trees surrounding the Kirby Dr. Wendy’s just a few weeks earlier. Does the axing of the XO trees along Portsmouth, Park, Revere, and Norfolk streets in Upper Kirby count as another illegal tree massacre?

A passerby stopping for an iced tea today at the McDonald’s across Kirby Dr. from the recently deforested Wendy’s restaurant at the corner of Kirby and North Blvd. reports that the once-bustling construction site has gone quiet: “Nothing going on at the site, looked closed, stopped, locked up.” But one bright marker affixed to a window of the mid-redo building at 5003 Kirby did catch our tipster’s eye: “I noticed the largest ‘red tag’ I have ever seen. 4 times the size of a normal one.” Unfortunately, the site is fully fenced, so there”s no way to read it without a good pair of binoculars.

The owner of the property at the southeast corner of Kirby Dr. and North Blvd. has indicated he might attempt to evict the Wendy’s franchise whose operator appears to have ordered the nighttime removal of 6 oak trees on public property surrounding the fast-food outlet earlier this week. Lias J. “Jeff” Steen, the property’s landlord, says he sent an email saying “I am extremely disappointed he took down the trees under cover of darkness . . . And I am looking at terminating our lease,” according to a report by abc13’s Deborah Wrigley.

Chopping Down of Trees along North Blvd. at Wendy's Restaurant, 5003 Kirby Dr., Upper Kirby, Houston

The City of Houston intends to proceed with legal action in connection with the overnight disappearance of half a dozen oak trees from the public right-of-way surrounding the Wendy’s drive-thru at 5003 Kirby Dr., according to 2 separate sources. The trees were chopped down and ground up on site under cover of darkness Tuesday night as part of a renovation of the fast-food spot, which sits at the corner of Kirby and North Blvd. The removals took place on city property, but had not been permitted by the city.

“I have already been assured by the City of Houston’s enforcement officer that the city intends to proceed with a civil case,” writes Trees for Houston executive director Barry Ward in an email sent to members of the canopy-enhancement organization this morning. He calls plans to pursue legal action “a continuation of the recent, positive trend by the current administration to put an end to illegal tree removal in the City right-of-way or on city property.”

Well, sure, there’s a new construction fence up, and some of the heavy machinery’s been moved around. But you might also note the sudden disappearance of 6 or 7 mature oak trees lining the streets surrounding the restaurant. How did they vanish so quickly? Tree crews have been working all morning to start the process of ridding the site at the corner of Westmoreland and Garrott of “many” of its large surrounding oak trees, a reader tells Swamplot. But only a single tree has been removed so far, as these photos show.

Drew St. The gentle warning tape wrapped around it appears not to have made much difference to the chainsaw operators who cut off its limbs last week, though. Had the tape been attached by a tree-hugging neighbor? Not exactly:

Tree and Home, 1704 Blodgett St., Museum Park, HoustonThe city has extracted $225,000 from the owners and contractors of a Bellaire developer who extracted two 100-year-old Live Oak trees from public property adjacent to 2 separate Inner Loop redevelopment sites over the summer. That’s a little less than half of the amount the city originally sought. The settlement ends the lawsuit it filed in October against Signature City Homes owner Barry Gomel and the demo contractor he hired to remove the 36-inch-diameter specimen pictured above at 1704 Blodgett St. (the home was torn down in July); it’ll also allow the developer to proceed with construction of the 4-townhome development it had planned for that location. The second tree was next to a bungalow Signature demolished at 801 Bomar.

A TREESTARTER FOR MEADOWCREEK VILLAGE PARK Map of Meadowcreek Village Park, Forest Oaks Blvd., Meadowcreek Village, HoustonThere’s no ponderous selfie video to go with the appeal (a more generic promotional vid from Trees for Houston is posted instead), but the Beautification Committee of the Meadowcreek Village Civic Club has taken to a crowdfunding site to raise money for twenty 15-gallon trees they hope to plant at drought-stricken Meadowcreek Village Park on Forest Oaks Blvd. just south of Allendale Rd. The $3,000 the committee hopes to raise from online donations won’t be going to buy the trees, however — Trees for Houston has already donated them. Instead, they’re trying to fund the trees’ watering costs for 2 years, which committee chair Joe Rocha figures will cost $75 per tree per annum. With a mere 43 days to go before the end-of-the-year watering-fund deadline, the campaign is almost a third of the way toward its goal. That vague line of pink barely visible low in the forested area just beyond the backyard of this house on Warm Springs Dr. in Post Oak Manor marks a few of the hundreds of trees the Harris County Flood Control District plans to knock down as part of a second phase of work on the easternmost portion of the Willow Waterhole Stormwater Detention Basin complex. Most of the trees slated for removal are in a 5-acre zone to the southeast of Post Oak Manor (outlined at the bottom right of the aerial map below), just north of South Main St. and directly to the southwest of Beren Academy. But the pink line is part of a separate 2-acre strip that’s slated for thinning just south of Post Oak Manor. And that’s got some residents there — and in adjacent ‘W’ neighborhoods Willowbend, Willow Meadows, Willowbrook, and Westbury — upset.

This is one of the trees that the city alleges was “wantonly” and “maliciously” chopped down over the weekend by developer Signature City Homes. (This and another 100-year-old live oak that used to stand across town on Bomar in Hyde Park.) In response, the city is seeking $500,000 in damages. The tree stood in front of 1702 Blodgett — which, you’ll remember, was demolished a few weeks ago to make room for 4 townhouses. That demolition was precipitated by an approved variance request by Signature City to reduce the setback on this lot at the corner of Blodgett and Jackson in Museum Park, just down the street from that strip center that caught fire in August.

KEEPING ONE MONTROSE TREE IN RESERVE The developer of those spur-side homes planned for this Westmoreland lot between Marshall and W. Alabama St. says that the old live oak shown in the photo isn’t going anywhere. In fact, Arpan Gupta tells Swamplot that a 1,410-sq.-ft. reserve area — as one commenter notes on the site plan — is being established around the tree’s “drip line” to set aside a park that not just the homeowners will be allowed to use. Additionally, explains Gupta, architecture firm Knudson and tree service Arbor Care have both been employed to take protective measures — mulching, fertilizing, fencing, etc. — during the “stress of construction.” [Previously on Swamplot] Photo: Allyn West

Before construction can begin next month on this 4-story apartment complex planned for the southwest corner of Cypresswood Dr. and the Tomball Pkwy., some things have to go. Developers Embry and Stonelake Capital appear to have in mind an unscraped 15.4-acre site that’s thick with trees, and Real Estate Bisnow’s Catie Dixon reports that the demise of an “existing structure” is imminent. But she doesn’t say which one. And neither has Embry. But: The manager at the Arby’s there on Cypresswood says it’s not the Arby’s.
