A Houston attorney says the site plan for the Ashby Highrise “substantially” copies the one a Dallas-based architecture firm created for the same developers 5 years ago. Patrick Zummo, who is representing Humphreys and Partners Architects in a lawsuit filed last week against Buckhead Investment Partners, tells the West U Examiner‘s Charlotte Aguilar that the plan for the Ashby Highrise site at the corner of Bissonnet and Ashby — which Buckhead attributes to the firm it hired later, EDI Architecture — is “extremely close, if not identical to” both a plan Humphreys drew up for the same site while under contract to Buckhead in 2006 and the site plan the architecture firm produced a few years earlier for the Grant Park Condominium tower in the Elliot Park neighborhood of Minneapolis (above).

An architecture firm headquartered in Dallas has filed suit against the developers of the Ashby Highrise, alleging that Buckhead Investment Partners made “copies and derivatives” of the firm’s design for the 27-story Grant Park Condominiums tower in Minneapolis. Humphreys and Partners Architects designed that complex (pictured above) in 2003. The lawsuit is also directed at EDI Architecture, the firm Buckhead hired to produce drawings for the proposed highrise at the corner of Bissonnet and Ashby near Southampton.

The lawsuit claims that Buckhead infringed on Humphreys’ copyright by submitting plans for a proposed 23-story tower at 1717 Bissonnet to the city of Houston. Those plans have already received permits. The lawsuit seeks an injunction to prevent Buckhead from constructing the building, because doing so would “necessarily create additional copies and derivatives” of Humphreys’ intellectual property.

TCBY Rice Village owners renewed their lease at 2518 Rice Blvd. but dropped the franchise affiliation of 15 years when that agreement recently came up for renewal — a 10-year commitment. Instead, the owners launched their own ice cream and frozen yogurt shop, Purple Vanilla — not be confused with nearby retailers Purple Mango (a children’s store) and Purple Glaze (a design-your-own ceramics studio).

Newer players in the frozen confection industry such as Red Mango and Swirll are typically self-serve shops, with some charging by the portion. TCBY, founded 30 years ago, has taken notice and incorporated self-serve into the new store model it recommended for the Rice Village store. Meanwhile, its existing locations with traditional counter service are considering whether and when to retool. Or, as in the case of Purple Vanilla, whether and when to leave.

PAYING THE ASHBY HIGHRISE AWAY Former apartment manager and accountant Randy Locke, who’s running for city council in the district that includes the site of the Ashby Highrise, has a plan to stop the proposed 23-story development at 1717 Bissonnet St. — but it’ll cost: “I don’t believe that the monies offered these builders were sufficient enough to get them to go away,” he tells reporter Chris Moran. “[Locke] did not identify the private interests he said offered the developers money, but pledged that, if elected, he would convene a meeting between the developers and those private interests within 30 days, and, “‘I’ll convince the other people that were chipping in the money to give them a little bit more and we’ll make the whole thing go away.’” [Houston Chronicle; previously on Swamplot; Ashby Highrise coverage]

The development company behind a proposed 23-story residential tower at 1717 Bissonnet near Southampton known as the Ashby Highrise submitted its plans to the city again today, after taking a 2-year break. Buckhead Investment partner Matthew Morgan tells the West U Examiner‘s Michael Reed that the plans sent in today are mostly identical to those submitted in August 2009. Those plans, which the city ultimately approved, were for a version of the tower that axed some of the buildings’ commercial features, including retail and office space and a pedestrian plaza in front of the building. The lawsuit Buckhead filed against the city early last year, challenging the repeated rejection of its earlier plans for the building, is still pending in U.S. District Court.

There is one notable difference in the new plans: The units will be rented, not sold, Morgan says.

How design blogger Joni Webb’s Calacatta slabs have been acclimating themselves to West U.: “Is white marble really practical in a kitchen? Yes, that age old question. Doesn’t white marble stain? I’ve had my marble countertops for almost three years now and I have to say, I don’t have any stains at all. But, what I do have are a few smudges. You can’t really see them unless you look sideways in the sunlight – and then you might notice that there are – for lack of a better word – smudges. These spots look like clear water dried on the marble. I know that all I need to do is get the marble cleaned and resealed again, but truthfully, these few marks don’t bother me at all.”

COMMENT OF THE DAY: SHARON TYLER’S TILES “I have to agree this house is over the top and she went ‘architect’ nuts with it. I actually live in one of the few other houses that Sharon Tyler built in West U. She built a few others and acted as the ‘architect/builder.’ I have to say the house is built super solid and has a timeless design to it. The bathrooms did have the Sharon Tyler signature floor to ceiling 2×2 tiles and that got old as soon as the 90s hit. Hoewever, in one of the bath remodels I brought a tile vendor to give me a quote to knock down all the tiles and put something more current. The guy liked the Sharon tiles so much that I thought he was going to hit me with a bat for wanting to tear them down. So to each its own. However, I have to say that having lived in a Sharon Tyler house, I have the outmost respect for that woman. No detail was overlooked and I understand she oversaw the construction herself and it was not uncommon for her to stop at the construction and asking to start from scratch on a particular job if she was not pleased with the work. MORE JOLTS FROM BUFFALO GRILLE COFFEE Now in the H-E-B Buffalo Market parking lot at Buffalo Speedway and Bissonnet, on the site of what used to be the Buffalo Grille: the first in a network of eVgo electric vehicle charging stations to be planted in parking lots around the city. The plug-in spots are right near what used to be the coffee serving area, notes Chronicle energy reporter Tom Fowler. Opening in the next couple of weeks: stations near NRG’s headquarters at the Shops at Houston Center downtown, and in front of 2 Walgreens: at 19710 Holzwarth St. and 8942 W. Sam Houston Pkwy. OUT WITH THE IMPORTED PO’ BOYS, IN WITH THE LOCAL BOLOGNA The owners of Benjy’s Restaurant next door plan to open a local-foods market in the recently vacated Antone’s Import Co. space at 2424 Dunstan St. Benjy Levitt describes the market, which he’s calling Local Foods in Rice Village, as a local version of its predecessor. There’ll be sandwiches and salads, as well as prepared foods from next door, including Benjy’s beer nuts and cheese crackers. It’s just about summertime, and all you fans of fresh West University produce know what that means: Yes, it’s well past time to set up those security cameras to monitor your vulnerable front-yard fruits. “The camera and fruit-thief deterrent signs have returned,” notes the reader who sent in these photos of this ripe “either peach or nectarine” tree on Tangley, west of Buffalo Speedway. But the security effort actually appears to be a bit more subdued than last year. The bilingual warning signage featured on the tree and a few of its neighbors last season has been replaced with a smaller and simpler handwritten “Camera” warning.

Swamplot’s West U fruit scout says there’s another sign on the other side of the tree “that says something like ‘Don’t even think about it.’” No photo of that? Explains the source: “I was in a hurry and, of course, wanting to stay out of the camera’s wily view.”

Open now: more space for books and readers in the 3116 Houston Ave. storefront at the end of Bayland in Woodland Heights. The expanded store incorporates the north end of the streetfront building, and includes a back yard and reading area.
  • Moving: The storefront division of PH Design Shop, from its Shepherd Dr. hangout next to Sugarbaby’s Cupcake Boutique, to a larger 1,440-sq.-ft. space at 2414 Rice Blvd. in the head-in-parking paradise of Rice Village, later this month. The new store will allow the addition of gifts and tabletop items to the store’s mix of custom mix of funky paper goods and custom design services.

This drive-by pic of the former Fu’s Garden Restaurant space at the corner of Kirby and University shows what looks to be the exfoliation of some of the building’s 1950s-era accoutrements. The longtime Rice Village restaurant closed quietly several months ago: “They seem to be removing the vertical louvers from the second story and boarding over the windows,” notes the reader who sent in the photo.

Late last week the Museum of Fine Arts Houston announced the names of 3 architecture firms selected as finalists to design the museum’s next expansion project. The new structure will go on the 2-acre parking lot at the northwest-ish corner of Bissonnet and Main. (Yes, that means the era of free MFAH parking is soon to be over.) The finalists are NYC’s Steven Holl Architects (designers of the Nelson-Atkins Museum of Art in Kansas City), Norwegian firm Snøhetta (designers of the roofwalk-friendly Norwegian National Opera and Ballet in Oslo), and LA’s Morphosis, (that’s their design for the Perot Museum of Nature & Science now under construction in Dallas, above). You can presume any possible competitors with some sort of Houston connection were axed from the list during the museum’s year-long series of interviews with 10 “international” design firms.
