Tree Stumps Along North Blvd., Wendy's Restaurant, 5003 Kirby Dr., Upper Kirby, Houston

The owner of the property at the southeast corner of Kirby Dr. and North Blvd. has indicated he might attempt to evict the Wendy’s franchise whose operator appears to have ordered the nighttime removal of 6 oak trees on public property surrounding the fast-food outlet earlier this week. Lias J. “Jeff” Steen, the property’s landlord, says he sent an email saying “I am extremely disappointed he took down the trees under cover of darkness . . . And I am looking at terminating our lease,” according to a report by abc13’s Deborah Wrigley.

Chopping Down of Trees along North Blvd. at Wendy's Restaurant, 5003 Kirby Dr., Upper Kirby, Houston

The City of Houston intends to proceed with legal action in connection with the overnight disappearance of half a dozen oak trees from the public right-of-way surrounding the Wendy’s drive-thru at 5003 Kirby Dr., according to 2 separate sources. The trees were chopped down and ground up on site under cover of darkness Tuesday night as part of a renovation of the fast-food spot, which sits at the corner of Kirby and North Blvd. The removals took place on city property, but had not been permitted by the city.

“I have already been assured by the City of Houston’s enforcement officer that the city intends to proceed with a civil case,” writes Trees for Houston executive director Barry Ward in an email sent to members of the canopy-enhancement organization this morning. He calls plans to pursue legal action “a continuation of the recent, positive trend by the current administration to put an end to illegal tree removal in the City right-of-way or on city property.”

Well, sure, there’s a new construction fence up, and some of the heavy machinery’s been moved around. But you might also note the sudden disappearance of 6 or 7 mature oak trees lining the streets surrounding the restaurant. How did they vanish so quickly? Tree-removal crews worked very quickly, overnight (see photo above left). Here’s another before-and-after comparison:

This fire-lane-accessible structure at 3200 S. Fry Rd., on the eastern edge of Cinco Ranch, will soon be the home of Los Robertos Taco Shop, a 3-location (soon to be 4-) chain expanding east from San Antonio. The taco outpost, which will stay open 24 hours, 7 days a week, will be taking over for the Chicken Express that closed at this spot earlier this year. Conveniently located immediately north of the Cinco Ranch Alzheimer’s Special Care Center, the drive-thru lies just one parking lot south of Westheimer Pkwy.

A CHICK-FIL-A IS GOING INSIDE PENNZOIL PLACE Pennzoil Place, 711 Louisiana St., Downtown HoustonIf there’s gonna be a downtown office building collecting a few fast-food drive-thru franchises in its basement — minus the drive-thru parts, that is — it might as well be one with some street cred, right? Last year, a Sonic moved into the basement of Pennzoil Place, the Philip Johnson-designed double-trapezoid building pair on the block bounded by Milam, Rusk, Capitol and Louisiana. The building’s owners are now about to carve out more space for retail on the building’s lower floors — though only one of the added slots (at the corner of Rusk and Louisiana) will actually have direct access to the street. Joining Sonic in the building’s underground tunnel zone — along with an expanded eating area, revamped escalators, and a few more lease spaces — will be downtown’s fourth Chick Fil A. But don’t line up quite yet: The projected $1.2 million in renovations necessary to create the new spaces won’t be complete until early next year. Even the arched facade mimics the townhome in the background. And let’s face, the neighborhood behind it is rapidly becoming a majority townhome area if it isn’t already. So maybe it does resemble the neighborhood after all. . . . If you seriously look at Montrose, it is just a polyglot of everything. A lot of it is butt ugly but the trees and grown out landscaping obscure it. My neighborhood and its adjacents are filled with homes, apartments, offices, etc. spanning 90 years of different styles and much of it is seemingly incompatible if viewed as a single entity. Construction of Raising Cane's, 1902 Westheimer Rd., Montrose, Houston

The signs are now up at the new building under construction at 1902 Westheimer Rd., across the street from the Winlow Westheimer shopping center. And they say: Raising Cane’s. And that means your center-of-Montrose drive-thru chicken finger spot will be opening very soon. Raising Cane’s is no stranger to Westheimer; the new restaurant will mark Raising Cane’s fourth location on the street (it’s got the 12201, 7531, and 5015 spots already). But this’ll be the first one inside the Loop.

W Grill, 4825 Washington Ave., Houston

What do the Smoothie King at the corner of S. Shepherd and West Alabama, the W Grill at 4825 Washington Ave. (pictured above), and the southern parking lot of the Taco Cabana at the corner of South Main and Old Spanish Trail have in common? They’re all shaped from former locations of Rally’s Hamburgers. After the burger chain’s exit from Houston in the mid-to-late nineties, the distinctive white structures with rounded corners and glass block were repurposed to a range of uses by subsequent tenants. Before its Smoothie King transformation, for example, the spot at 3007 S. Shepherd Dr. did time as a bank. A location of Checkers Drive-in (a rival chain that later merged with Rally’s) at the northwest corner of Antoine and West Tidwell was transformed into a Church’s Chicken — before, that is, being scraped for a drive-up retail box housing a payday lender and a wireless store.

Construction of New Raising Cane's Chicken Fingers Restaurant, 1900 Westheimer Rd., Montrose, Houston

Opposite the pedestrian-friendly Winlow Westheimer shopping center at the corner of Westheimer and Hazard St. that includes the recently de-Firkinized Phoenix bar, a new Raising Cane’s Chicken Fingers fast-food joint is about to go up — on a 35,000-sq.-ft. lot that’s been vacant since the 2-story pushed-to-the-street building once home to Martha Turner Properties was torn down on the site almost 6 years ago. The reader who sent in the photo above reports that a construction supervisor on site claimed the new chicken joint will be alive and kicking within 3 or 4 months.

Construction of McDonald's and Capital One Bank, 1510 Studemont St., Sixth Ward, HoustonReader Debnil Chowdhury sends in these pics, taken yesterday, of the steel-framed structure that’s appeared over the last month just north of the new Studemont Kroger gas station in the formerly industrial district just south of I-10 that Swamplot readers have dubbed ‘Katyville’ — in honor of the suburban-style developments rapidly going in there, a mere 2 miles northwest of Downtown. And these latest additions do appear to be pad-site-alicious: Directly north of the McDonald’s going up at 1510 Studemont St. (and pictured here), there’s a sign announcing a new Capital One Bank. There’s no indication yet whether the bank building will have a drive-thru as well, but the signs look good.

Shepherd, I became curious about the temporary fencing which was being erected around the northeast quarter of the parking lot. So, I stopped, and spoke to a couple of men who were reviewing a fairly large roll of blueprints on the lowered tailgate of a truck. I had a little head rush when I was told that a new Chick Fil-A was about to be erected . . . right there in the parking lot. Makes sense, as I can’t remember that portion of the lot ever being full of cars. A similar scenario took place last year at the Lowes down the street. Part of that property which held a retention pond is now home to a brand new CVS. A Downtown office building named after an oil company featuring a new drive-in in its basement? Well, minus all the close-in parking spots. Swamplot reader Doug Gober sends pix showing signs advertising a new Sonic Drive-In plastered earlier this week on the darkened windows of the spot occupied until a few months ago by a General Joe’s Chopstix — in the tunnel-access basement space of Pennzoil Place at 711 Louisiana. Walk-in seating for underground customers is already available, but you’ll probably have to place your order inside.
